Studio Rental & Membership Terms and Conditions
Nassau, The Bahamas
This Studio Rental & Membership Agreement (“Agreement”) governs all bookings, studio use, and memberships at Tonya Alexis Studios (“Studio”, “we”, “us”, “our”) located in Nassau, The Bahamas.
By booking, renting, or using the Studio in any capacity, you (“Renter”, “Photographer”, “Creative”, “Member”, “you”, “your”) agree to be bound by these Terms in full.
Important: This Agreement is a business template and should be reviewed by a Bahamian attorney before final use to ensure full compliance with the laws of The Bahamas.
1. Parties & Scope
1.1 Studio Owner:
Tonya Alexis Studios, Nassau, The Bahamas.
1.2 Renter / Member:
The individual, photographer, videographer, creative or company who books or uses the Studio, whether on a one-time rental or as part of a monthly Studio Membership.
1.3 Scope:
This Agreement covers:
Hourly / daily studio rentals
Studio Membership Passes (monthly packages)
Use of Studio space and any Studio-provided equipment
2. Booking, Payment & Cancellations
2.1 Booking Confirmation
Bookings are confirmed only after payment of the required fee (rental or membership) is received and processed.
We reserve the right to release any unpaid time slot to another client without further notice.
2.2 Payments
Payments may be made via the methods specified by the Studio (e.g. bank transfer, cash, electronic payment).
All payments are non-refundable unless otherwise stated in writing by the Studio.
2.3 Rescheduling / Cancellations – Standard Rentals
Reschedules requested at least 48 hours before the booking may be allowed once, subject to availability and Studio approval.
Cancellations or reschedules requested within 48 hours of the booking start time may result in forfeiture of the full rental fee.
2.4 Studio Memberships
Membership fees are billed monthly in advance and are non-refundable.
Unused studio days or hours do not roll over to the next month.
Memberships renew month-to-month unless written notice is provided at least 30 days before the next billing cycle.
2.5 No Refund Policy
All studio rental fees, membership fees, retainers, and payments made to Tonya Alexis Studios are non-refundable.
By booking or purchasing a Studio rental or Membership, you acknowledge and agree that:
Your time slot is reserved exclusively for you.
Once your booking is confirmed, we block that time on the Studio calendar and may turn away other paying clients for the same date and time.The Studio incurs costs and preparation before your session.
This includes administrative time, scheduling, communication, studio cleaning and setup, and, where applicable, allocation of equipment for your booking or membership.Last-minute changes are difficult to re-book.
Due to the nature of studio rentals and limited availability, cancellations and no-shows often result in time that cannot reasonably be re-filled.
For these reasons, no refunds will be issued for:
Change of mind
Client cancellations or no-shows
Lateness that results in reduced usable time
Failure to use allocated membership days or hours within the billing period
Dissatisfaction with the creative results produced by the Renter/Photographer/Creative using the Studio
If the Studio must cancel or reschedule for reasons within our control (e.g., unexpected Studio maintenance, emergency closure), we will offer:
An alternative date/time, or
A Studio credit of equivalent value, or, in rare cases and at the Studio’s sole discretion, a refund.
Any such remedy will be the Renter’s sole and exclusive remedy in relation to a Studio-initiated cancellation.
3. Access, Time & Overtime
3.1 Access Window
Rental times include set-up, shoot time, and tear-down/clean-up.
You and your clients may arrive no earlier than your scheduled start time and must fully vacate the Studio by your scheduled end time.
3.2 Overtime
Overtime is billed in 1 hour increments at the current overtime rate set by the Studio and your membership rate.
3.3 Keys / Entry
Access will be provided via Studio staff or agreed method.
Under no circumstances may you duplicate any keys or share door codes without written permission from the Studio.
4. Studio Use & Conduct
4.1 Permitted Use
The Studio may be used for:
Photography
Videography
Content creation
Small workshops or similar professional uses agreed in advance
4.2 Prohibited Activities
The following are strictly prohibited unless expressly approved in writing:
Smoking, vaping, or use of illegal substances on the premises
Open flames, candles, fireworks, or hazardous materials
Weapons or replicas that may cause alarm or violate law
Adult entertainment / explicit content that violates community standards or laws
Excessive noise, aggressive behavior, or activity that disturbs neighbours or other tenants
4.3 Noise & Respect
Music and noise must be kept to a reasonable level.
You are responsible for ensuring that clients and attendees behave respectfully and safely at all times.
4.4 Cleanliness
Renter must leave the Studio in a clean and orderly condition, including:
Removing all personal items and trash
Wiping surfaces used
Returning furniture and equipment to their original positions
Excessive mess (confetti, glitter, food spills, etc.) may incur a cleaning fee at the Studio’s discretion.
5. Clients, Guests & Full Responsibility
5.1 Your Clients & Guests
You are fully responsible for the behaviour, safety, and actions of all persons you bring into the Studio, including clients, models, assistants, makeup artists, stylists, friends, and children.
5.2 Full Responsibility Clause
You agree that you, not the Studio, bear full responsibility for:
Any incidents, accidents, or injuries involving your clients or guests while they are in your care or on the premises during your rental or membership time.
Any damage to property, equipment, furnishings, or the building caused by you, your clients, or your guests.
5.3 Minors
Any person under 18 must be accompanied by a parent/guardian or a responsible adult authorized in writing by the parent/guardian.
You are responsible for ensuring minors are supervised at all times.
6. Equipment & Props
6.1 Standard Use
The Studio may provide:
Backdrops
Stands
Basic lighting equipment (e.g. continuous lights, basic modifiers)
Furniture and small props
The specific equipment included will be confirmed in your rental or membership agreement.
6.2 Membership Equipment Access
Certain Studio Membership Passes may include access to additional or higher-level equipment (e.g. strobes, specialty modifiers, stands, reflectors).
Equipment access is tier-based and will be communicated to you when you join your Membership Pass.
6.3 Proper Handling
You agree to use all Studio equipment and props carefully and as intended.
You agree not to:
Alter, disassemble, or attempt to repair any equipment
Tape, glue, or permanently attach anything to equipment or walls
Stand on furniture or use gear in a way that could cause damage or injury
6.4 Equipment Failure / Unavailability
If a piece of Studio equipment becomes unavailable or fails unexpectedly, the Studio may offer a reasonable alternative if available.
The Studio is not liable for any loss of income, disruption, or inconvenience arising from equipment malfunction beyond refunding the portion of the rental fee directly related to the unusable equipment, at the Studio’s discretion.
6.5 Personal Equipment
You may bring your own cameras, lights, and gear.
The Studio is not responsible for loss, theft, or damage to any personal or client equipment/property brought onto the premises.
7. Damage, Security & Fees
7.1 Damage Responsibility
You are fully responsible for any damage to:
Studio walls, floors, furniture, fixtures, and decor
Studio equipment, backdrops, stands, and props
Any common areas or neighbouring property damaged by you, your clients, or guests
7.2 Damage Assessment
The Studio will assess the damage and provide a repair or replacement cost.
You agree to pay all such costs promptly upon notice.
7.3 Security & Loss
The Studio is not liable for any theft, loss, or damage to personal belongings, vehicles, or client items brought to the Studio or its surroundings.
You are responsible for safeguarding your own and your clients’ property.
8. Health, Safety & Legal Compliance
8.1 Safety First
You must conduct your session or event in a safe manner at all times.
You agree to comply with all applicable laws, regulations, and building rules of The Bahamas.
8.2 Hazardous Behaviour
The Studio reserves the right to immediately terminate a session without refund if any activity is deemed dangerous, illegal, or grossly disrespectful, or if it puts people or property at risk.
8.3 Emergency Procedures
You agree to follow all fire, safety, and emergency procedures as outlined by the Studio or building management.
9. Photography Rights, Releases & Privacy
9.1 Client & Model Releases
You are solely responsible for obtaining all necessary:
Model releases
Property releases
Parental consent forms for minors
Permissions for any creative content produced during your rental
9.2 Content Ownership
As the photographer/creative, you retain the rights to your creative work, subject to your own agreements with your clients.
9.3 Studio Promotional Use
With your consent, the Studio may request to share behind-the-scenes photos or general images of the Studio in use (not your client’s private images) for promotional purposes.
Any such usage will respect client confidentiality as agreed between you and your clients.
10. Liability & Indemnification
10.1 Limitation of Liability
To the maximum extent permitted by the laws of The Bahamas, the Studio (including its owner, staff, and representatives) shall not be liable for:
Any injury, loss, or damage to persons or property arising from your use of the Studio, except where such injury, loss, or damage is directly caused by the Studio’s gross negligence or willful misconduct.
Any consequential, indirect, or special damages, including loss of income, whether in contract or tort.
10.2 Indemnification
You agree to indemnify and hold harmless the Studio, its owner, and representatives from and against any and all claims, damages, liabilities, costs, and expenses (including legal fees) arising from:
Your use of the Studio
The actions or omissions of you, your clients, guests, employees, or contractors
Any breach of this Agreement
This includes, without limitation, claims related to personal injury, property damage, and alleged violation of rights (e.g., privacy or intellectual property).
11. Termination & Refusal of Service
11.1 Right to Refuse
The Studio reserves the right to refuse bookings, terminate memberships, or stop a session immediately if:
The Renter violates any term of this Agreement
The Renter engages in illegal, aggressive, dangerous, or inappropriate conduct
The Studio reasonably believes its space, equipment, reputation, or other clients are at risk
11.2 No Refund in Case of Misconduct
In cases of serious violation or misconduct, no refund will be provided.
12. Studio Membership Specific Terms
12.1 Membership Nature
A Studio Membership grants you limited, non-exclusive use of the Studio only during booked and approved time slots.
Membership does not grant ownership, tenancy, or any legal interest in the premises.
12.2 Scheduling
Members must book studio days/hours in advance via the Studio’s scheduling process.
Bookings are subject to availability and membership tier priority.
12.3 Equipment by Tier
Different membership tiers may include different levels of equipment access (e.g., basic lights vs. full kit).
The Studio reserves the right to update available equipment and membership inclusions, with reasonable notice.
12.4 Non-Transferable
Memberships are personal to the Member and may not be transferred, shared, or resold without written consent from the Studio.
13. Governing Law & Entire Agreement
13.1 Governing Law
This Agreement is governed by and construed in accordance with the laws of The Commonwealth of The Bahamas.
13.2 Entire Agreement
This Agreement constitutes the entire understanding between the Studio and the Renter/Member regarding studio rental and membership and supersedes all prior discussions or agreements, whether written or oral, on this subject.
13.3 Amendments
Any amendment to this Agreement must be in writing and agreed to by the Studio.
14. Acknowledgment & Signature
By making a booking and using the Studio, you confirm that:
You have read, understood, and agreed to this Agreement in full.
You are at least 18 years old and legally able to enter into this Agreement.
You accept full responsibility for yourself, your clients, and your guests while using the Studio.
